Transportation Impact Fee Program
Appeals and Payments Under Protest
The Director or a designee determines the applicability of the impact fee to
a given development activity within the City. An applicant may pay the TIFs
under protest in order to obtain a permit. After the TIFs have been paid, an
appeal shall be filed to the hearings examiner within 10 days of the City’s
final decision regarding the amount of the impact fee under the provisions
of
Chapter 18.94 DMMC. The applicant must also pay the hearings examiner
appeal fee of $1,350.00. The appeal can only be made by the owner of the
property where such development activity shall occur.
