Status as of September 28, 2007:
The trucking and placement of exported soils at the corner of South 261st Place
and 20th Avenue South from a different job site in Des Moines is nearing
completion. During the time period week of September 25-28, 2007, the city
authorized filling activity to resume. Approximately 70% of that work was
completed, but rain on the last day caused the activity to be cancelled. The
remaining fill work is authorized for the week of October 1-5, 2007. It is
anticipated that this work will take 1 ½ days.
Project Background:
In July of 2004, the City of Des Moines received a Rezone Application entitled
the Mitchell/Chamlain Rezone: Land Use Action Number LUA04-018. The application
specifically requested changed the zoning designation of east 8.62 acres of
three tax parcels east of 20th Avenue South and west of Pacific Highway South
(parcels 2822049067, 2822049209, and 2822049233) from Community Commercial to
Residential: Attached Townhouse and Duplex (RA-3600). The remaining west 1.42
acres of the tax parcels remained zone Community Commercial.
On November 18, 2004, October 13, 2005, November 17, 2005, and December 29,
2005, the City of Des Moines City Council conducted the public hearing for the
proposed Mitchell/Chamlain Rezone application. On December 29, 2005 the Des
Moines City Council approved
Ordinance 1372, which officially amended the City’s
Zoning Map and changed the zoning designation of east 8.62 acres of three tax
parcels east of 20th Avenue South and west of Pacific Highway South (parcels
2822049067, 2822049209, and 2822049233) which contained approximately acres from
Community Commercial to Residential: Attached Townhouse and Duplex (RA-3600).
In April of 2006, the City received the application materials for a preliminary
modified subdivision entitled “Landmarque”. The application specifically
requested to divide the 3 existing tax parcels into 66 attached single family
lots (townhouses), 2 detached single family lots, and 1 commercial lot. All
residential units are located within the RA-3,600 zone. As part of the project,
the developer will be required to widen 20th Avenue South in order to provide
sufficient emergency access to the subdivision as required by the City’s street
standards and Ordinance 1372.
Since the proposed modified subdivision is not categorically exempt from State
Environmental Policy Act (SEPA) pursuant to WAC 197-11-800 and DMMC 16.04.230,
the applicant was required to submit an Environmental Review Application. Based
on the evaluation of the SEPA checklist, the City issued the final threshold
determination of a Mitigated Determination of Non-Significance (MDNS) on March
26, 2007. The comment period for the MDNS notice and appeal concluded on April
10, 2007 and April 20, 2007, respectively, with no comments or appeals filed.
On June 14, 2007, the City Council conducted a public hearing to determine if
the proposed preliminary modified subdivision entitled Landmarque is consistent
with the requirements for a townhouse subdivision. The City Council determined
that the proposed subdivision was consistent with the Des Moines Municipal Code,
the Des Moines Comprehensive Plan, and the conditions of approval established by
Ordinance 1372 and approved
Resolution 1046 approving the preliminary plat
entitled “Landmarque”.
